These Terms govern use of services operated by Alpha Brands & Assets AG across aplaud.me, magic-code.net, applause.website and related functionality.
Users must provide appropriate account information and protect credentials. Unauthorized access, account takeover and security circumvention sind verboten.
Unter 13 Jahren: kein Konto. Ages 13–17 kann subject to guardian/capacity restrictions and limits on monetization, affiliate participation and payout.
Creating an account, ID or Event kann free. Public publication is a separate paid action. The current standard Publication Fee is €1 / CHF1 / USD1 or local equivalent unless the interface states otherwise. It is not an account activation fee.
Created but unpublished items kann remain visible only to the logged-in owner. A published item kann unpublished later where supported; unpublishing does not automatically trigger a refund.
Ordinary Applause is voluntary appreciation and does not automatically purchase underlying content. Applause to Reveal kann an access condition for digital content.
The supported legal/product states are Public, Applause to Reveal / Gated, and Private & Confidential.
Private & Confidential Content is restricted to one or a finite number of recipients selected by the sender. A public preview does not automatically make the underlying private layer public. Where Applause is required, Recipient Authorization + Reveal Condition = Access. If anyone can unlock merely by paying, the content is gated rather than automatically private interpersonal communication.
Mandatory consumer rules kann still apply to paid or Applause-conditioned access, including private delivery. Immediate digital access should use the required express request/acknowledgement flow where applicable.
Alpha Brands does not normally require creators to satisfy external-platform follower/view/click thresholds to use its own monetization tools. No earnings are guaranteed.
Standard references: Magic Applause 85% Creator / 15% Platform. Benefit Partner configuration: 90% Event Owner pool / 10% Platform, with the Benefit Partner allocation coming from the Event Owner pool. Vote 70/30. Quiz 70/30. Brands and Shopping kann use a default Qualified Lead reference of €1 and 70/30 unless a campaign/dashboard states otherwise.
Transaction-specific rates shown at the time of the transaction are locked for that transaction and are not arbitrarily reduced retroactively, except for refunds, fraud, chargebacks, errors or invalid activity.
Magic Coins are closed-loop internal platform units. Standard-Referenz: 1 MCN = €0.01. Consumer MCN balances are separate from Creator/Benefit/Affiliate fiat balances.
Eligible users kann submit a Withdrawal Request once the applicable balance reaches €10 or equivalent. Alpha Brands normally processes a valid request within 72 hours; this is not a guarantee of bank/PayPal receipt time. Holds kann apply for fraud, disputes, sanctions, incorrect payout details or legal obligations.
Nutzer behalten bestehende Rechte in uploads and grant only the technical license necessary to host, store, display, transmit, format, resize and generate technical previews. Linking external content does not prove ownership or authorization.
Subject of Applause kann differ from Content Owner, Event Owner and Revenue Recipient and does not automatically imply consent, endorsement or revenue entitlement.
Alpha Brands kann remove or restrict content, disable Codes or shortlinks, suspend monetization or accounts, and hold payouts where justified by law, security, fraud or the Terms. Applicable DSA procedures are provided separately.
Physical Magic Code stickers or other tangible goods are separate products and require applicable Terms of Sale, shipping, returns, withdrawal and warranty information.
Grundsätzlich gilt Schweizer Recht the contractual relationship, subject to mandatory local/EU consumer protections and other non-excludable rights.
